Offer for the purchase of goods on the Bozzor.uz marketplace

I, as the"Buyer", agree that this document has the status of an official public offer drawn up in accordance with the regulatory legal acts of the Republic of Uzbekistan, including Articles 369 and 426 of the Civil Code of the Republic of Uzbekistan and the Law of the Republic of Uzbekistan "On Electronic Commerce" (new edition). By accepting this Public Offer (hereinafter referred to as the Offer), I fully agree to the following terms and conditions: This public offer is an official offer, a public offer of the Joint Venture Limited Liability Company "Bozzor.uz". The transaction is concluded using the Marketplace with any individuals who have the legal capacity to conclude a transaction on the terms defined in this offer. The Buyer must read this Offer in full before using the Marketplace. The fact of the Buyer's registration on the site, use of any functions, software capabilities of the Marketplace means full and unconditional acceptance (acceptance) of this offer by the Buyer.


1. Terms and definitions

Capitalized terms used in this Agreement have the following meanings, unless otherwise explicitly provided in the text of the Agreement:

1.1. Bozzor.uz AND / OR Bozzor.uz - LLC "BOZZOR MARKET TECHNOLOGIES" TIN 306252268, which is the owner of the Marketplace where offers addressed to Buyers on concluding a contract for the purchase and sale of Goods with Sellers under the terms of this Offer are placed.

1.2. MARKETPLACE - an online e-commerce platform that combines the following addresses: https://Bozzor.uz, Bozzor.uz databases, the Android and iOS mobile application, as well as a set of intellectual property objects, including, but not limited to software registered in accordance with the procedure established by law, design (graphic design), photos, and information published by Bozzor.uz and/or the Seller and/or other persons with the consent of Bozzor.uz and other results of intellectual activity that allow the purchase and sale of Goods remotely.

1.3. WEBSITE - Bozzor.uz website located at a unique address https://Bozzor.uz (domain name). The domain name and/or content of the website may be changed at the discretion of Bozzor.uz without the consent of the Buyer.

1.4. THE Buyer PARTY or Bozzor.uz, depending on the context of this Offer.

1.5. THE PARTIES are the Buyer and Bozzor.uz.

1.6. BUYER – an individual with legal capacity, successfully registered on the Site and purchasing the Seller's Goods by placing an order in the Marketplace and accepting this offer.

1.7. SELLER – a legal entity, individual entrepreneur, or professional income tax payer (self-employed) who carries out activities related to the sale of goods through the Marketplace to the Buyer using a remote method and has been registered on the Marketplace.

1.8. Financial partners – legal entities that have an agreement with BOZZOR MARKET TECHNOLOGIES LLC to provide Goods to Customers in installments.

1.9. PRODUCT – food and non-food Products sold by the Seller to Customers using the Marketplace and being the subject of a purchase and sale agreement concluded between the Buyer and the Seller.

1.10. STORE — an online store located on the Marketplace, through which the Buyer purchases Goods under this Offer. The store has unique product numbers, a store identification number, and a link. The store includes Product Cards created in it, a rating, reviews, and a store card.

1.11. PROMOTION – events held by CUREl MARKET TECHNOLOGIES LLC or the Seller aimed at attracting customers and promoting certain types of goods, by reducing prices for goods or other actions.

1.12. PROMO CODE – a type of promotion that allows you to get a discount on products.

1.13. PERSONAL ACCOUNT – a software module for online interaction of the Buyer with the Marketplace at https://Bozzor.uz, used for placing Orders for goods, which can be accessed after registration using the Buyer's username and password.

1.14. AUTHORIZATION - - the procedure for identifying the Buyer by entering their phone number and confirmation code by phone number via sms to access their Personal Account.

1.15. CODE - personal identification number, which serves as an additional means of protection against unauthorized authorization and receipt of the Order, is analogous to the Buyer's handwritten signature.

1.16. OFFER – a public offer of LLC "BOZZOR MARKET TECHNOLOGIES" for the purchase of goods on the Marketplace, the acceptance of which by the Buyer entails the conclusion of a Contract on the terms specified in the Offer.

1.17. AGREEMENT – this Offer accepted by the Buyer.

1.18. SALES PRICE OF GOODS — the price of a specific Product set by the Seller, at which it is sold to the Buyer, and which consists of the cost price of the Product, the Seller's mark-up and Bozzor.uz remuneration. The selling price cannot be higher than the average market prices for similar products.

1.19. PRODUCT PRICE —the price of a specific Product set by the Seller and which consists of the cost price of the Product and the Seller's mark-up. The price of a Product cannot be higher than the average market prices for similar products. The Agreement may use terms and definitions that are not defined in this section of the Offer. In this case, the term or definition is interpreted in accordance with its literal meaning. In the absence of an unambiguous interpretation of the term or definition in the text of the Offer, you should be guided by the interpretation of the term defined, first of all, by the legislation of the Republic of Uzbekistan, and second of all, by the established (generally used) on the Internet

2. Legal framework

2.1. This public offer is developed in accordance with the Civil Code of the Republic of Uzbekistan, the laws of the Republic of Uzbekistan "On Electronic Commerce", "On electronic document management" and other regulatory legal acts that regulate the implementation of the sale of goods (works, services) and the conclusion of an e-commerce contract. The public offer is available on the official website of the Marketplace at: : https://Bozzor.uz and http://Bozzor.uz/public-offer.

2.2. Relations in the field of consumer rights protection are regulated by the Civil Code of the Republic of Uzbekistan, the Law of the Republic of Uzbekistan "On Consumer Rights Protection". 2.3. This public offer defines and establishes the procedure and conditions for the Buyer to purchase Goods from the Seller when using the Marketplace.

3. General provisions

3.1. Bozzor.uz has the right to make changes to this Offer unilaterally without notifying the Buyer. All changes take effect immediately after publication, and are considered to be brought to the Buyer's attention from the moment of such publication.

3.2. The term of validity of the Offer is not limited, unless otherwise indicated on the Marketplace's website.

3.3. . Bozzor.uz under the contract with the Buyer does not act as a person who directly delivers the Goods for the benefit of the Buyer. All relations between the Seller and the Buyer concerning the delivery of Goods are regulated by the contract between the Seller and the Buyer.

4. Procedure for accessing orders on the marketplace

4.1. To get access to the use of the Marketplace, the Buyer must register by filling out the registration form on the site, namely: specifying the name, phone number (login), confirming the phone number by SMS message by clicking on the "Register" button. By performing the registration procedure, the Buyer gives Bozzor.uz consent to the processing, collection and storage of their personal data (including special ones), as well as gives consent to the transfer of Bozzor.uz's personal data to third parties.

4.2. . The Buyer hereby gives his consent to receive the newsletter from Play Mobile LLC (specify the company that will send SMS codes to Buyers during registration), by means of a short message (SMS) to the mobile phone number specified by the Buyer during registration.

4.3. The Buyer independently creates a password to log in to the Personal Account. At the same time, the Marketplace has the right to set requirements for the password when forming it (length, allowed characters, etc.).

4.4. After the Buyer has successfully completed the registration procedure, the Buyer has the opportunity to place orders for Goods on the Marketplace.

4.5. The Buyer's personal data specified in the Merchant Profile is stored and processed by Bozzor.uz in accordance with the terms of the Privacy Policy, which is set out in a separate document and posted on the Website atу: Bozzor.uz.

5. Procedure for placing an order on the marketplace

5.1. When using the Marketplace, the Buyer can search for information about Products and purchase the necessary Goods. The product is presented on the site through graphic images-samples that are the property of the Marketplace. The photos accompanying the Product are simple illustrations to it and may differ from the actual appearance of the Product. The Product descriptions/specifications accompanying the Product do not claim to be exhaustive and may contain typos. For more information about the Product, the Buyer should contact the Seller. Due to different monitor specifications, the color of the Product may differ from the one shown on the website. Finding information about a Product on the Marketplace is not a guarantee of its availability in stock.

5.2. The following ways of receiving Goods are available to the Buyer: Courier delivery to the specified address within the city of Tashkent.

5.3. Bozzor.uz and the Seller may entrust the fulfillment of their obligations under the agreement with the Buyer to third parties, while remaining responsible for their actions

5.4. When placing an Order (by clicking the "Place Order" button or any other similar button), the Buyer confirms that:

  • information about the Goods purchased by the Buyer is brought to the Buyer's attention in full. According to Article 427 of the Civil Code of the Republic of Uzbekistan and the Law "On Consumer Protection", the Seller undertakes to provide the Buyer with the necessary and reliable information about the product offered for sale, which meets the requirements established by law or usually imposed in retail trade for the content and methods of providing such information.
  • he / she has read this Offer in full, that he / she fully understands it, and also understands and agrees with the subject matter and terms of the Contract concluded with the Seller; the Buyer has read all the essential terms and conditions of the sale of the Goods. Essential conditions for the sale of Goods are indicated by the Seller on the page with the Product description.

5.5. To verify the Buyer when transferring the Order, the Buyer is shown a code in the Order information section of the personal account, which the Buyer can use to receive the goods. Delivery of Goods is made upon presentation by the Buyer of the code generated in the Personal Account.

6. Payment procedure for the product

6.1. The price of Goods on the Marketplace is indicated in the national currency of the Republic of Uzbekistan – in Uzbek soums and includes value added tax.

6.2. Payment for Goods on the Marketplace is carried out in cash and non-cash funds (at the Buyer's choice) by transfer through payment systems, or by payment by bank card through a payment terminal.

6.3. The Buyer makes the payment in favor of Bozzor.uz, which acts on behalf of the relevant Seller with the involvement of an authorized payment acceptance operator or an electronic money operator and is the recipient of the payment as the Seller's commission agent.

6.4. In cases stipulated by the current legislation, when paying for an Order on the Internet, the cash receipt is sent to the email address specified by the Buyer when placing the Order.

6.5. In cases when the Buyer returns the Goods and demands a refund, the Seller returns the money to the Buyer in accordance with the procedure established by the legislation of the Republic of Uzbekistan.

6.6. As a general rule, the refund of the amount of money paid to the Buyer for the Goods is made in the same form as the payment for the goods was made, unless otherwise provided by the agreement of the parties.

7. Procedure for receiving goods

7.1. Upon receipt of the Order, the Buyer must present the Bozzor.uz Code generated in the Buyer's Personal Account in the Order information section. If the generated and submitted Code matches, Bozzor.uz has the right to issue the Order to the person who submitted it.

7.2. In order to check the exclusion of fraud when handing over a prepaid Order, the administrator of the point of issue of the order or the courier has the right to request the Buyer to present an identity document of the Buyer.

7.3. The Buyer's failure to appear at the Order Collection Point within the time period specified in clause 7.3. of this offer and failure to perform other necessary actions to accept the Goods during courier delivery are considered as the Buyer's refusal of the Goods. In this case, the Order is returned and the money paid for the Product is refunded.

7.4. When placing an Order, the Buyer has the right to choose delivery of the Goods to the Buyer at the address and within the time limits agreed upon during the Order. The exact cost of delivery of the Product is determined when placing the Order.

7.5. At the time of receiving the Order, the Buyer is obliged to check the Order at the order collection point or from the courier (upon delivery) for any defects in it. If the Buyer has not verified the Order, Bozzor.uz is responsible for defects in Order execution if the Buyer proves that they occurred before the Order was received.

8. Refusal and exchange of goods of proper quality

8.1. The Buyer has the right to refuse the Goods of proper quality at any time before their transfer, and after the transfer of the Goods, if the goods do not have any defects, but do not fit in size, color, technical characteristics and other reasons, has the right to refuse within 10 calendar days from the date of purchase (for food products – 24 hours) return, exchange a non-food product of proper quality for a similar one from the Seller where it was purchased, and receive a refund.

8.2. The return of Goods of proper quality is possible provided that the goods were not in use, the packaging with a barcode (qr code), factory labels, tags, seals are preserved, the presentation, consumer properties are preserved, as well as a document confirming the fact and conditions of purchase of the specified Product.

8.3. The commercial appearance is recognized as preserved, provided that the appearance of such Goods together with the consumer packaging of the manufacturer allows for its further sale to another buyer. The absence/damage of packaging, traces of use (including one-time use), which do not allow the Product to be sent for re-sale, are an obstacle to further sale of the Product by the Seller and indicate that the product appearance is not preserved.

8.4. The Buyer confirms that he is familiar with the List of non-food products of proper quality that are not subject to return or exchange for similar goods, approved by Resolution of the Cabinet of Ministers of the Republic of Uzbekistan No. 75 dated 13.02.2003.

8.5. If the Buyer refuses the Goods of proper quality, the cost of delivery services is non-refundable.

9. Refusal and exchange of goods of improper quality

9.1. The Buyer to whom the Goods with defects are sold, if this was not agreed upon by the Seller at the conclusion of the contract, has the right, at its own discretion, to demand:

  • replacement of a good quality product of the same brand (model, article number);
  • replacement for the same product of a different brand (model, article number) with the corresponding recalculation of the purchase price;
  • gratuitous elimination of defects in the product or reimbursement of expenses for correcting defects by the consumer or a third party;
  • a proportionate reduction in the purchase price;

9.2. The Buyer may exercise the rights specified in clause 9.1. if the defects are detected during:

  • the warranty period or expiration date of the product;
  • six months for products for which warranty periods and expiration dates are not set;
  • two years from the date of transfer of real estate to the consumer, if longer terms are not provided for in the contract;
  • the period established by the Government of the Republic of Uzbekistan for seasonal goods.

9.3. Bozzor.uz does not set a warranty period for Goods. This time limit is set by the manufacturer or Seller of the Product.

10. Rights and obligations of the parties

10.1. Bozzor.uz undertakes to:

  • Comply with the terms of this Offer.
  • Bozzor.uz bears other obligations in accordance with the current legislation of the Republic of Uzbekistan.

10.2. Bozzor.uz has the right to:

  • Change the terms of this Offer unilaterally by posting them on its Website.
  • All changes come into force immediately after publication, and are considered to be brought to the Buyer's attention from the moment of such publication.
  • Without the consent of the Buyer, transfer their rights and obligations to fulfill certain terms of the transaction and in accordance with this Offer to third parties in the interests of the Buyer.
  • Take any reasonable measures to detect and prevent illegal actions using the Marketplace.
  • If the Buyer purchases promotional Goods, Bozzor.uz has the right to refuse to transfer the goods to the Buyer's ownership in case of violation of the terms of participation in the promotions.
  • Has the right to demand to present a passport, if this is due to the characteristics of the product and the terms of the promotion.
  • If the Buyer violates this Offer and/or commits illegal actions, the Marketplace has the right to block the Buyer's Personal Account, or restrict the functionality of the Buyer's use of the Marketplace.
  • Bozzor.uz has other rights in accordance with the current legislation of the Republic of Uzbekistan.

10.3. The Buyer undertakes to:

  • Read the text of this Offer and comply with its terms.
  • When registering in your Personal Account, provide truthful, accurate and complete information about yourself and keep this information up-to-date.
  • When using the Marketplace, comply with the legislation of the Republic of Uzbekistan and international norms governing commercial activities, as well as the rights and interests of third parties.
  • Provide reliable information about yourself (full name, contact phone numbers, email address) and details for the delivery of Goods.
  • Immediately notify Bozzor.uz of any unauthorized (not authorized by the Buyer) access to the Personal Account using the Buyer's account and/or of any violation (suspicion of violation) of confidentiality and access to the Personal Account.
  • Carefully check the correctness of placing the selected Order (amount, selected Product, quantity of Goods, etc.) before its payment.
  • Do not transfer your username (phone number) and password to third parties,and thereby be responsible for the safety of your username (phone number) and password.
  • To avoid disputes, read the Product information when placing an Order.
  • Use the Product in good faith exclusively for its functional purpose, in accordance with the operating rules (if any).
  • Comply with the terms of participation in current promotions held by Bozzor.uz. The terms of each promotion are regulated by a separate offer, which is posted on the official website of Bozzor.uz and will be an integral part of this Offer and is mandatory for all participants of the promotion.
  • Comply with the terms of the User Content Policy on Resources, which is an integral part of this Offer.
  • The Buyer bears other obligations in accordance with the current legislation of the Republic of Uzbekistan.

10.4. The Buyer is entitled to:

  • Request that the duly ordered and paid Goods be handed over to the buyer.
  • Purchase Goods on the Marketplace in installments on the terms and conditions established by the Financial Partners.
  • The Buyer has other rights in accordance with the current legislation of the Republic of Uzbekistan.

11. No warranty or buyer's warranty

11.1. Bozzor.uz:

  • does not enter into a partnership, joint venture, agency or employment relationship with the Buyer;
  • is not a guarantor of any Seller;
  • does not determine whether the Buyer is responsible for paying any taxes;
  • does not collect or pay any taxes on behalf of the Buyer that may arise as a result of the Buyer's use of the Marketplace;
  • within the scope of the Goods purchased by the Buyer, it is exclusively a person who provides the Buyer with the opportunity to purchase the Seller's Goods using the functionality of the Marketplace and is a person who directly sells the goods to the Buyer;
  • for all claims related to the delivery of goods, the Buyer must contact the Seller directly;
  • the Seller is solely responsible for the goods delivered to the Buyer;
  • ) is not responsible for the actions performed in the Buyer's Personal Account by third parties who received the Account as a result of their illegal actions;

11.1.1. The Marketplace is presented "as is", i.e. it means that for problems that arise during the installation, updating, maintenance and operation of the Marketplace (including compatibility problems with other software products (packages, drivers, etc.), non-compliance of the results of using the Marketplace with the expectations of the Buyer, etc.), Bozzor.uz is not responsible,.

11.2. The Buyer guarantees that:

  • is a legally capable individual;
  • has the legal capacity to conclude agreements that have legal obligations;
  • has a valid and verifiable email address and mobile phone number;
  • has full and unlimited access to the specified payment method;
  • provide Bozzor.uz with your real name and true and correct personal data, and do not use a pseudonym or someone else's identity (even with the consent of the person whose identity the Buyer uses) or does not provide false, inaccurate or misleading personal data. The Buyer acknowledges that providing false personal data or means of identification may result in criminal liability;
  • is fully aware of the content of the expression of his will and the subsequent legal consequences;
  • has read this Offer and these terms and conditions are acceptable to the Buyer;
  • undertakes to perform in good faith and properly the obligations imposed by the Offer;
  • undertakes to immediately inform Bozzor.uz in writing of any circumstances that may contradict the Buyer's statements and/or may lead to a violation of the above guarantees. In addition, the Buyer must inform Bozzor.uz about the occurrence of such circumstances that may threaten the proper fulfillment by the Buyer of the obligations imposed by this Offer;
  • by agreeing to this Offer, the Buyer gives Bozzor.uz its consent to the collection, processing and storage of the Buyer's personal data, as well as to their transfer to third parties.

12. Liability of the parties

12.1. For non-fulfillment or improper fulfillment of the terms of this Offer, the Parties are responsible in accordance with this Offer and the current legislation of the Republic of Uzbekistan.

13. Force majeure

13.1. The Parties are released from liability for partial or complete non-fulfillment of obligations under this Offer if this non-fulfillment is caused by force majeure (force majeure), that is, extraordinary, unavoidable and unforeseen circumstances under these conditions caused by natural phenomena (earthquakes, landslides, hurricanes, droughts, etc.) or socio-economic factors.economic circumstances (state of war, blockades, import and export bans in the public interest, etc.), as well as other circumstances that are recognized as force majeure under the current legislation of the Republic of Uzbekistan, independent of the will and actions of the Parties, in connection with which they cannot fulfill their obligations under the Offer.

13.2. In the event of force majeure (force majeure), the established deadlines for fulfilling the obligations specified in the Offer are postponed to the period during which force majeure (force majeure) circumstances apply.

13.3. A Party that is unable to perform its obligations under the Offer due to force majeure must notify the other Party in writing of the occurrence and termination of the above circumstances no later than 3 (three) business days from the date of their occurrence and termination.

14. Dispute Resolution procedure

14.1. Disputes and disagreements that may arise from this Offer or in connection with them, the Parties will seek to resolve through mutual negotiations within 30 working days from the date of notification to one of the Parties of the dispute.

14.2. If a peaceful settlement of the dispute is not possible, this dispute is subject to final settlement in the State court in accordance with the procedure established by law.

15. Other terms and conditions

15.1. The owner of the exclusive rights to the Marketplace, including, but not limited to, the rights to the domain name, the posted logo of the Marketplace, databases, and all technical developments that allow the use of the Marketplace, is LLC "BOZZOR MARKET TECHNOLOGIES".

15.2. The Buyer is not entitled to use the Marketplace in ways not provided for in this Offer, including extracting information in any form in ways not provided for in the Offer.

15.3. In the event that any provision of this Offer is deemed invalid, illegal or unenforceable in accordance with applicable law, all other provisions of the Offer will remain in full force and effect. In such a case, the Parties are obliged to replace the invalid, illegal or unenforceable provision with a mutually acceptable legitimate, legal and legally binding provision that is consistent, as far as possible, with the spirit and purpose of the invalid, illegal or unenforceable provision.

15.4.All issues not directly regulated by the Offer are regulated in accordance with the legislation of the Republic of Uzbekistan.
